REQUIREMENTS FOR MARRIAGE

REQUIREMENTS FOR SOLEMNIZATION OF MARRIAGE

 

1. Application of a marriage license at the Consulate General in Shanghai has to be filed by both parties in person.  The marriage license has to be filed in the location of the wedding ceremony.   Applications are RMB250 each (total RMB500). ONLY FILIPINO CITIZENS CAN BE MARRIED IN THE CONSULATE.

 

2. The Consulate General would then have to publish a notice of the application of marriage for 15 consecutive working days  before the actual wedding ceremony at the Consulate,

 

3. Solemnization ceremonies at will be held at the Consulate. The fee is RMB600.00

 

Documentary requirements are as follows:  Solemnization of Marriage (For Filipino Couples)

 

1. Original and three (3) copies of Authenticated Birth Certificate which has to pass through

       A. National Census and Statistics Office
B. Department of Foreign Affairs (Authentication Section)

 

2. Original and three (3) copies of Certificate of Non-Availability of Record of Marriage which has to pass through

       A. National Census and Statistics Office
B. Department of Foreign Affairs (Authentication Section)

 

3. Original and three (3) copies of Authenticated Parental Consent (if an applicant is from 18-20 years old), or Original and one (1) copy of Authenticated Parental Advice (if an applicant is from 21-25 years old) which has to pass through :

 

       A. Notary Public
B. Regional Trial Court
C. Department of Foreign Affairs (Authentication Section)

 

4. Passport (4) Copies of Data page and Picture page) or Affidavit of Identity / Nationality (Available at the Information Counter).

 

5. Two (2) Passport-sized Pictures (for those holding a with valid passport) or Four (4) Passport-sized Pictures (for those with no passport or holding an expired/invalid passport).

 

6. Baptismal Certificate and Transcript of Record (School Record) or School Diploma (If applicant has no passport or expired/invalid passport or/and if there are discrepancies on the date of birth or/and name in the certified documents such as the passport, Birth Certificate, etc.).



REQUIREMENTS FOR

LEGAL CAPACITY TO CONTRACT MARRIAGE

 

Filipinos marrying foreigners in China are required to obtain a Certificate of Legal Capacity to Contract Marriage from the Consulate to be presented to the Chinese authorities. 

 

To obtain the certificate, the applicant should secure first from the Philippines the following documents:

 

1. Original and one (1) copy of Authenticated Birth Certificate which has to pass through:

A. National Census and Statistics Office

B. Department of Foreign Affairs (Authentication Section)

 

2. Original and one (1) copy of Certificate of Non-Availability of Record of Marriage which has to pass through:

B. National Census and Statistics Office

C. Department of Foreign Affairs (Authentication Section)

 

Once these documents are obtained, submit these together with the following:

 

1. Duly Accomplished Form No. O5 for Legal Capacity to Contract Marriage

 

2. Passport (1) Copy of Data page and Picture page)

Three (3) to Five (5) Working Days
